Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the PassOn marketplace app and the website at passonmarket.co.uk (together, the “Service”), operated by PassOn (“PassOn”, “we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who we are

PassOn is a marketplace that lets people buy and sell pre-loved and secondhand items. PassOn provides the platform; the contract of sale for any item is between the buyer and the seller directly. PassOn is not a party to that sale unless expressly stated.

2. Eligibility & accounts

• You must be at least 18 years old (or the age of majority where you live) to use the Service.
• You are responsible for the information you provide and for keeping your login details secure. You are responsible for activity on your account.
• You must provide accurate information and keep it up to date.

3. Buying and selling

• Sellers are responsible for their listings being accurate, lawful and not misleading, for owning or having the right to sell the items, for pricing, and for dispatching sold items promptly.
• Buyers are responsible for reading listings carefully before purchasing and for paying through the Service.
• Payments and payouts are processed by our third-party payment provider. Fees, if any, will be shown before you confirm.
• Where offered, buyer/seller protection, delivery and returns are subject to the specific policies shown in the Service.

4. Prohibited items & conduct

You must not list or sell counterfeit, stolen, unsafe, illegal or otherwise prohibited items, and you must not use the Service to harass, defraud, spam, infringe others’ rights, or break the law. We may remove listings or content that breach these Terms.

5. Fair, human-run moderation

We aim to moderate the Service fairly and transparently. Moderation decisions are made by our team, we will not issue bans without a reasonable basis, and where we take action against your account we will endeavour to tell you why and, where appropriate, give you a route to appeal. We may suspend or remove accounts that seriously or repeatedly breach these Terms.

6. Your content

You keep ownership of the content you post (such as listing photos and text). You grant PassOn a non-exclusive, worldwide, royalty-free licence to host, display and use that content to operate and promote the Service. You are responsible for the content you post and confirm you have the rights to it.

7. Fees

Using the Service may be subject to fees, which will be made clear before you incur them. We may change our fees from time to time; changes will not apply retroactively to completed transactions.

8. Intellectual property

The PassOn name, logo, software and the design of the Service are owned by PassOn or its licensors and are protected by law. You may not copy, modify or reverse-engineer the Service except as permitted by law.

9. Availability & changes

We may update, suspend or discontinue parts of the Service, and we may change these Terms. If we make material changes we will take reasonable steps to notify you. Continued use after changes take effect means you accept the updated Terms.

10. Disclaimers

The Service is provided “as is”. To the extent permitted by law, we do not guarantee that listings are accurate or that transactions will complete, and we are not responsible for the acts of buyers or sellers. Nothing in these Terms excludes liability that cannot be excluded under law, including your statutory consumer rights.

11. Limitation of liability

To the extent permitted by law, PassOn is not liable for indirect or consequential losses, or for loss arising from a transaction between users. Our total liability to you in connection with the Service in any 12-month period is limited to £100 (one hundred pounds), except where such liability cannot be limited by law. Consumers’ non-excludable statutory rights are unaffected.

12. Termination

You may close your account at any time. We may suspend or terminate your access if you breach these Terms or where necessary to protect the Service or other users.

13. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, unless mandatory local law provides otherwise for consumers.
